When can data be blocked?
This article explains under which conditions North Data blocks data.
Blocking of Data
We will block data upon request under the following conditions.
Conditions for blocking entries on persons
- Obsolete data: The person is no longer acting as a legal representative (in any company within the network), and their function(s) as a legal representative(s) date back at least:
- Managing directors, board members, and equivalent positions: 5 years after resignation/retirement
- Liquidators: 5 years after the expiry of the function,
- Authorized representatives: One year after leaving their position
- Personal liability as a registered merchant: One year after the expiry of the Commercial Registry entry
- Legal representatives in registered associations: after leaving their position
- Special need for protection. Please explain in your request the special interest in blocking your data, or provide suitable evidence for it.
Requirements for Blocking Entries for Companies
- Outdated data with personal reference
- Company has been terminated for five years (associations, merchants: one year)(the means that the liquidation phase has been completed), and
- the request is made by the liquidator or last managing director; or a survivor/heir of the same, and
- the name of the company has a direct personal reference, and
- the company was an association, a company in the category of German “Kleinstkapitalgesellschaft” or equivalent
- Please explain these in your request, or provide appropriate evidence for it.
Procedure for Blocking Request
Please make your request in writing (ideally by e-mail to info@northdata.com).
The following information is required:
- The specification of the web address (URL) or the web addresses to which the block request relates to
- A justification for the blocking, i.e., which of the above requirements are met
- Authorization of the applicant (legal representative in companies)
- Legitimation (the applicant’s e-Mail address is, in most cases, sufficient) or presentation of your power of attorney
- For France, please provide us the SIREN number
We reserve the right to refuse requests - especially if a particular public interest in the entries prevails, if the request is incomplete, does not meet the above mentioned requirements, or contains false information as well as, for France, in cases in which the status of distribution of the data on sirene.fr is indicated as releasable (French: “diffusible”).
Restriction on data dissemination on Sirene (INSEE) - only for France
For the specific case of France, it is possible to request a restriction on the dissemination of your data through the Sirene service. This process can be completed online (here) by the person concerned. Once the status of your data is changed to “diffusion partielle”, we invite you to inform us.
Key Information:
Since 2023, the “diffusion partielle” status has replaced the previous “non-diffusible” status. This new dissemination regime increases transparency for certain data. For individuals, the following elements are now made public:
- SIREN and SIRET numbers,
- Associated municipality and country, ● Administrative status, ● Economic indicators.
This reform also applies to legal entities, allowing them to hide their specific location data while making essential information visible.
Rights of legal entities under GDPR (Article 21):
- Only location data (number, street, and geolocation of the address) can be hidden.
- However, the municipality remains visible.
Exceptions for complete non-dissemination:
Complete suppression of dissemination is strictly limited to specific situations:
- Public entities managing salaries for certain administrations (tax authorities, URSSAF, etc.) whose data is exclusively accessible to the relevant authorities.
- Organizations under the National Defense, subject to prior authorization from the Ministry of Defense, in accordance with Article A 123-95 of the Commercial Code.
